(“sownbeauty”). sownbeauty operates this store and website, including all related information, content, features, tools, products and services to provide you with a curated shopping experience (the “Services”). sownbeauty is powered by Shopify, which enables us to provide the Services to you.


These Terms of Service (the “Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services.


Please read these Terms carefully. They include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. When you place an order, you are making an offer to purchase. sownbeauty may accept or decline your order at its discretion. We must receive and process payment before acceptance. Please review your order carefully before submitting; we may be unable to accommodate cancellation requests after acceptance. If we do not accept, change, or cancel an order, we will attempt to notify you at the email, billing address, and/or phone number you provided.

You represent and warrant that your purchases are for personal or household use and not for commercial resale or export.

 

 

SECTION 4 – PRICES AND BILLING

 

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless expressly stated, posted prices exclude taxes, shipping, handling, and any customs/import charges.

SECTION 5 – SHIPPING AND DELIVERY

 

Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs, weather, or events outside our control. Title and risk of loss pass to you upon transfer of products to the carrier.

If a package is marked delivered but you did not receive it, please contact the carrier first and then our support team; resolutions may vary by carrier and circumstances.

sownbeauty’s names, logos, product and service names, designs, and slogans are trademarks of sownbeauty or its affiliates/licensors. You must not use such trademarks without prior written permission. Shopify’s marks are trademarks of Shopify. Other marks belong to their respective owners.

 

 

SECTION 7 – OPTIONAL TOOLS

 

We may provide access to third-party tools that we neither monitor nor control. You acknowledge that access is provided “as is” and “as available” without warranties or endorsement. sownbeauty is powered by Shopify, which enables us to provide the Services. Sales and purchases are made directly with sownbeauty. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and sownbeauty, including any injury, damage, or loss from purchased products/services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with sownbeauty.

We may monitor, edit, or remove Feedback at our discretion. You agree not to post unlawful, infringing, obscene, or misleading content or any malware/viruses. We may terminate this agreement or your access to the Services (or any part) at any time in our sole discretion without notice. You remain liable for all amounts due up to and including the date of termination. Sections that by their nature should survive (including IP, Feedback, Disclaimers, Limitation of Liability, Indemnification, Severability, Waiver/Entire Agreement, Assignment, Governing Law, and Privacy) will survive termination.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SOWNBEAUTY OR OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS/REVENUE/SAVINGS, LOSS OF DATA, REPLACEMENT COSTS), WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. Our total liability to you for any claim shall not exceed the amount you paid to us for the product(s) giving rise to the claim.

You agree to indemnify, defend, and hold harmless sownbeauty, Shopify, and their respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, and expenses (including reasonable attorneys’ fees) arising out of or related to: (1) your breach of these Terms or referenced policies; (2) your violation of law or third-party rights; or (3) your access to or use of the Services. We will notify you of any indemnifiable claim; lack of prompt notice will not relieve you unless materially prejudiced. We may control the defense and settlement (at your expense) and will not agree to any settlement imposing non-monetary obligations on you without your consent (not unreasonably withheld).

These Terms and any separate agreements whereby we provide Services shall be governed by and construed in accordance with the laws of the State of Nevada, USA, without regard to conflict-of-law principles. You and sownbeauty consent to the exclusive jurisdiction and venue of the state and federal courts located in  Nevada.
